You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against the Company.
Governing law and jurisdiction
These terms of use and any dispute or claim arising out of or related to them shall be governed by and construed in accordance with the laws of the State of Nevada, without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding not subject to arbitration shall be instituted exclusively in the courts of Washoe County, Nevada or the United States District Court for the District of Nevada, and you consent to the jurisdiction of such courts.
Severability
If any provision of these terms of use is held by a court or arbitrator to be invalid, illegal, or unenforceable, such provision shall be eliminated or limited to the minimum extent necessary, and the remaining provisions of the terms shall continue in full force and effect.
Entire agreement
These terms of use, together with our Privacy Policy, constitute the sole and entire agreement between you and CitizenWorks LLC regarding the website and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the website.
